HOW TO PLACE AN ORDER
To place an order online, add items to your shopping cart or wish list by clicking on the "Add to Cart" or "Add to Wish List" button on the product page. Wish lists will not place it on order, but will be saved for possible future purchases. Click on the "Quick Order" button for quick order entry by product number. Your order summary can always be accessed by clicking on the "Shopping Cart" icon located at the top of the page. You can also proceed to checkout from this point.
To speak to a representative, call our Customer Care Department on our toll free number during regular business hours(800) 544-7938. After business hours, you can leave your order on our voice mailbox, (or send us a TOLL FREE fax at (877) 892-9197) or, request a return call from our Customer Care Department.
For mail orders, use the convenient order form and return envelope found in this Harris Seeds catalog.
EXTREMELY IMPORTANT: Those who have ordered from us before will have been assigned a customer number that appears just above your name on our correspondence to you including the back cover on your catalog. To ensure prompt service from us, please include your customer number on all correspondence or phone calls to us.
PAYMENT METHODS & CASH DISCOUNTS: Most of our payment methods offer additional cash discounts. We have an attractive standard discount program for all of our buyers, and an additional 2% "loyalty discount," for customers who purchased from us last season.

For customers with established credit terms with Harris Seeds: At checkout - Select "Pre-Approved Harris Seeds Credit Terms" in the Payment Method section and enter your customer number on the next screen. If you currently do not have credit terms, and wish to, please download an Application for Credit (Acrobat Reader required) or request one via our TOLL FREE NUMBER (1-800-544-7938) and mail or fax it back to us.
If you desire Credit Terms (ship now – pay later), Harris Seeds offers the following options:
30 Day Pre-Approved Invoicing – Our 30 day invoicing program still allows you the opportunity to earn additional discounts although at a reduced rate from that of our "cash with order program". By choosing this option, you will receive the following added discount for orders over $ 250.00.
Orders $250.00 to $1999.99 – 1%
Orders $2000.00 to $7499.99 – 3%
Orders $7500.00 or greater – 5%
Please note: To be eligible for 30 day invoicing you must have pre-approved credit and have a minimal initial order of $100.00 or higher. Cash discounts are offered on all products except plugs and liners. Discounts are forfeited and a 1½% per month late fee will be assessed on all invoices past due.
Extended Terms:Our Extended Terms Program allows you to receive your seed now and defer your payment to our pre-determined dates listed below. These terms are only available on flower and vegetable seed orders.
Flower Seed: Orders placed prior to April 30th will be payable May 1st. Orders placed after May 1st will be payable May 1st of the following year.
Vegetable Seed: Orders placed prior to July 31st will be payable August 1st. Orders placed after August 1st will be payable August 1st of the following year.
To be eligible for our Extended Terms Program, you must have pre-approved credit, and have a minimum initial order of $1,000. No standard discounts are available, and a 1 1/2% per month late fee will be assessed on all invoices paid after the due date.
BONUS LOYALTY DISCOUNTS!*
To all our customers that purchased a net total of $250.00 or more from us last season, we offer an additional 2% discount for all our payment programs. It’s our way of saying thank you for being a loyal Harris Seeds customer. (Plugs and liners excluded.)
If you purchased a minimum of $250.00 (or more) from us last season, (July 1st, 2007 to June 30th, 2008), you will receive the following additional discount.
Examples:
Cash with your order:
Orders $250.00 to $1999.99 – 3% plus 2%, a total of 5%.
Orders $2000.00 to $7499.99 – 5% plus 2%, a total of 7%.
Orders $7500.00 or greater – 7% plus 2%, a total of 9%.
30 Day Invoicing:
Orders $250.00 to $1999.99 – 1% plus 2%, total of 3%.
Orders $2000.00 to $7499.99 – 3% plus 2%, total of 5%.
Orders $7500.00 or greater – 5% plus 2%, total of 7%.
Extended Terms: All of our extended terms customers from last season (July 1, 2007 – June 30, 2008) who placed and paid for orders with us of $250.00 or more will receive an additional 2% discount on all orders this. Thus, the listed price less the 2% loyalty discount.

RETURNED CHECK FEE
A $20.00 fee will be charged on the return of all checks by the bank.
SALES TAX:
Sales tax will be charged on all New York State and Massachusetts purchases unless a resale certificate is included with your initial phone or mail order or we have it on file. Sales tax will not be charged to a customer if we have a tax exemption certificate on file from a previous year’s order. Please enter your Tax Exempt ID in the Tax Exemption section at checkout. If you currently do not have a tax exemption certificate on file with us, please click here to download the form. Simply fill it out and MAIL OR FAX it back to us.
SHIPPING & HANDLING CHARGES
(includes outbound freight and packaging materials). All orders are subject to the following shipping and handling charges, based on the total value of your order. All shipments outside the contiguous United States and large truck orders are subject to additional charges:

All orders (except back orders) are shipped within 48 hours of receipt. EXPEDITED/RUSH SERVICE IS AVAILABLE: Please call for details.
We will select a delivery service for your order. We normally use the United States Post Office or UPS. Please advise us if you require a special carrier. Any Next Day and Second Day shipping charges (at customer’s request) will be added to your order. Large seed/supply orders shipped by truck are subject to additional charges. ALASKA and HAWAII: Additional shipping charges may apply.
IMPORTANT: We need your complete parcel delivery address for prompt delivery of your order. If you have a P.O. Box, make sure you give us your street number as well.
RETURN/REFUND POLICY
All orders returned to us within 30 days from delivery are entitled to a refund or credit, and may be subject to a 15% restocking fee. They must be returned in unopened, saleable condition. All orders being returned to us must be accompanied by a return authorization number (RMA#). This number can be attained by calling our Customer Care Dept. at 800-544-7938. No returns accepted from previous sales season.
Prices are effective to June 30, 2009 and are subject to change without notice.
PRORATE POLICY
All seed listed for sale in this catalog is subject to delivery by our growers and suppliers. In the event that a variety is not delivered in full, we may choose to prorate the amount sold to each customer.
IMPORTANT NOTICE TO BUYERS
Garden Trends, Inc., DBA Harris Seeds (Harris Seeds) hereby states, as its sole and express warranty, that the live material it sells (seeds, plants, sets, bulbs, corms, and any other live material) will conform to only those label descriptions that are required by State and Federal Seed Law. HARRIS SEEDS DISCLAIMS AND MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, NOR ANY WARRANTIES OF MERCHANTABILITY OR OF FITNESS FOR A PARTICULAR PURPOSE, OTHERWISE. TO THE EXTENT PERMITTED BY STATE AND FEDERAL SEED LAW, ALL LIVE MATERIAL IS SOLD AS IS.
For any person or company reselling Harris Seeds live material, it is their responsibility to inform their customers of Harris Seeds conditions of sale and limited warranty. Such people or companies agree to irrevocably indemnify, save and hold Harris Seeds, its affiliates, officers, directors and agents harmless from and against any and all claims, demands, losses, liabilities, costs, expenses or other damages, including reasonable attorneys' fees and disbursements to any third party, person or entity whatsoever which arises out of any warranty, whether express or implied, made by said dealer in connection with any resale of the live materials.
Harris Seeds further disclaims any liability for any and all alleged seed borne or plant borne disease losses, whether the alleged infection is seed or plant borne or secondary-caused. Harris Seeds makes no representation regarding the live material it sells as free from seed or plant borne disease. Purchasers' exclusive compensation for loss or damage arising from purchase or use of live material from Harris Seeds shall be limited to an amount equal to the purchase price of such live material. There shall not be included in any amount for incidental or consequential damages, nor for amounts expended in using or growing such live material, nor for harvesting the produce of such seeds or reselling of any live material. This limitation of liability shall be applicable to any claim presented to HARRIS SEEDS, regardless of the legal theory forming the basis of such claim and whether such theory involves negligence, contractual liability, or otherwise. All orders accepted subject to availability. These disclaimers or warranties and limitations of liability of Harris Seeds may not be altered or amended, except by an instrument, in writing, signed by an authorized representative as designated by the President and CEO. Absent such written instrument, Harris Seeds shall not be bound by any provision set forth in any buyer's purchase order or other written or electronic document. By acceptance of the live material, the buyer acknowledges the disclaimers and limitations herein described are conditions of sale and that they constitute the entire agreement between the parties regarding warranty or any other liability. Any claim resulting from the use of Harris Seeds’ live material must be presented to Harris Seeds within 30 days after any defect or other basis of such claim was discovered or should have been discovered during the growing season in which the live material was purchased. Harris Seeds will not assume any responsibility after the above-mentioned 30-day period. Some states do not allow the exclusion or limitation of the incidental or consequential damages, so the above limitation or exclusion may not apply to you. This warranty gives you specific legal rights, and you may also have other rights that vary from state to state.
IT IS EXPRESSLY UNDERSTOOD THAT ANY TECHNICAL INFORMATION GIVEN BY HARRIS SEEDS IN REFERENCE TO THE USE OF ITS PRODUCTS IS GIVEN GRATIS. FURTHERMORE, HARRIS SEEDS DOES NOT ASSUME ANY RESPONSIBILITY FOR THE ADVICE GIVEN OR THE RESULTS OBTAINED.
ARBITRATION/CONCILIATION/MEDIATION REQUIRED BY SEVERAL STATES
Under the seed laws of several states, arbitration, mediation or conciliation is required as a prerequisite to maintaining a legal action based upon the failure of seed to which this notice is attached to produce as represented. The consumer shall file a complaint (sworn for AR, FL, IN, MS, SC, TX, WA; signed only for CA, GA, ID, ND, SD) along with the required filing fee (where applicable) with the missioner/Director/Secretary of Agriculture, Seed Commissioner, or Chief Agricultural Officer within such time as to permit inspection of the crops, plants or trees by the designated agency and the seeds-man from whom the seed was purchased. A copy of the complaint shall be sent to the seller by certified or registered mail or as otherwise provided by state statute.
